No Separate Signup Required: We don't require a separate signup process. Simply logging in or accessing our service constitutes your acceptance of these Terms and Privacy Policy. Each time you log in or use our service, you reaffirm your agreement to the then-current version of these Terms.

Legal Binding: If you do not agree to these Terms and our Privacy Policy, do not access or use our Service. Your continued use after any changes to these Terms constitutes acceptance of those changes.

2. Service Description

Hypnofy provides on-demand personalized hypnosis sessions designed to help users overcome life challenges and enhance performance. We create customized audio sessions based on information you provide about your specific needs and goals.

3. Important Health and Safety Disclaimers

NOT MEDICAL TREATMENT: Hypnofy and its practitioners are not licensed medical doctors, psychiatrists, psychologists, or counselors. We do not diagnose, treat, cure, or prevent any medical or psychological disorders. Our services are for wellness and personal development purposes only.

HYPNOSIS UNDERSTANDING: All hypnosis is self-hypnosis. Our certified hypnotherapist acts as a coach or guide to assist you in learning how to more fully use your innate talents and abilities to empower and direct yourself. At no time will you relinquish your free will and will participate only at a pace and level of involvement which is desirable and beneficial to you.

RESULTS NOT GUARANTEED: Success in using hypnosis is dependent on many variables, including attitude, motivation, cooperation, and the use of the tools provided. Individual results may vary, and we make no guarantees about outcomes.

TECHNOLOGY DISCLAIMERS: Our personalized sessions are created using artificial intelligence and voice synthesis technology. While we strive for accuracy and quality, AI-generated content may contain errors or imperfections. Voice synthesis technology creates audio using cloned voice technology, which may not be perfect reproductions. We continuously work to improve our technology but cannot guarantee flawless output.

NOT EMERGENCY SERVICES: Our services are not intended for mental health emergencies or crisis situations. If you are experiencing a mental health emergency, please contact emergency services immediately or call a crisis hotline.

4. Eligibility and Age Requirements

You must be at least 18 years old to use Hypnofy. By using our Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

5. Account Registration and Security

To use our Service, you must create an account by providing accurate information including your name and email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

6. Payment Terms

Pricing: Our services are available for one-time purchase through Stripe payment processing.

Payment: All fees are due at the time of purchase. We accept major credit cards processed through Stripe.

Refunds: We offer a 30-day, 100% money-back guarantee. To request a refund, contact us within 30 days of purchase.

7. Intellectual Property and Usage Rights

Our Content: All personalized hypnosis sessions, scripts, audio recordings, and other content created by Hypnofy are protected by copyright and remain our exclusive property.

Your License: Upon purchase, you receive a personal, non-exclusive, non-transferable license to access and use your personalized content for your personal use only.

Restrictions: You may not:

Share, distribute, or make your personalized sessions available to others
Copy, modify, or create derivative works from our content
Use our content for commercial purposes
Reverse engineer or attempt to extract our methodologies

Violation Penalties: Unauthorized sharing or distribution of your personalized content may result in immediate account termination and legal action. We reserve the right to seek damages for intellectual property violations.

Lifetime Access: Your purchased sessions remain accessible to you indefinitely through our platform, subject to these Terms.

8. User Content and Safety Obligations

Information You Provide: You may provide personal information about your challenges, goals, triggers, and experiences to help us personalize your sessions.

Testimonials: We may request optional testimonials about your experience, which you may choose to provide or decline.

Accuracy: You agree to provide accurate and complete information and to update it as necessary.

Safety Requirements: You agree to:

YOUR USE OF THE SERVICE IS AT YOUR OWN RISK

13. Indemnification

You agree to defend, indemnify, and hold harmless Hypnofy and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may terminate or suspend your access to the Service at any time, with or without cause or notice, for conduct that we believe violates these Terms or is harmful to other users or us.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after such changes constitutes acceptance of the new Terms.

16. Governing Law and Disputes

These Terms are governed by Nevada state law without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Nevada.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
